According to the, Temporary foreign worker program- TFWP, Canadian employers were eligible to recruit at least 20% International workers for low wage sectors in the country and 80% citizens need to be hired under the program. But after implementation of the new rules from 26 September, canadians can recruit only 10% low wage workers for the particular task.
However there is exception in the construction worker and health care sector workers where employers can recruit total 20% employees from the international countries.
International workers who are working in Canada as a low wage worker through LMIA Can only get visa for 1 year in Canada. However earlier, workers were able to work in the country for at least 2 year in a single visa. But now if you want to work in Canada then should complete your task within 1 year as you need to visit your native country to apply for the new Visa accordingly.
It is important to note that these changes will be implemented only those International workers were working as low wage worker.
The Refusal to Process (RTP) policy will apply to all Census Metropolitan Areas (CMAs) where the unemployment rate is more than 6%. This means that employers in these sectors will not be allowed to hire foreign workers unless they are in sectors with severe shortages, such as healthcare, construction and food processing.
A Labour Market Impact Assessment (LMIA) is a document issued by Employment and Social Development Canada (ESDC) that confirms a Canadian employer’s need to hire a foreign worker. It’s a permission slip that allows an employer to hire a foreign worker when they can’t find a suitable Canadian citizen or permanent resident for the job.
The LMIA process involves the employer demonstrating that they’ve made efforts to recruit Canadian workers and that hiring a foreign worker won’t negatively impact the Canadian labor market. The LMIA is usually required for foreign workers who need a work permit to work in Canada.
